La presente investigación tiene como objetivo comprender el proceso sociocultural que enfrentan las parteras tradicionales de San Felipe del Progreso, en el que estructuras y prácticas distintas entre sí —como son el sistema tradicional y el moderno de salud— se encuentran y permiten la aparición de nuevas interpretaciones, prácticas y objetos en la atención del embarazo, el parto y el puerperio. Para ello resulta necesario dividir la investigación en diferentes apartados. En un primer momento, se ahonda en el concepto de (...) modernidad y cómo es vista en Latinoamérica; de igual forma se menciona la manera en que se manifiesta en México, comprendida como la sucesión de diversos procesos de modernización suscitados en el ámbito económico, social, político y cultural. Una vez comprendido lo anterior, es posible discutir el concepto de lo híbrido, retomando la premisa de que dichos procesos de modernización se establecen en un espacio que contaba con formas distintas de mirar y construir la realidad, visión que se refleja en los procesos salud/enfermedad/atención. En un segundo momento, se observa el fenómeno en una comunidad concreta, a saber, San Felipe del Progreso, que da cuenta, desde su contexto, del encuentro entre estas dos formas de mirar el proceso salud-enfermedad-atención, que por un lado están caracterizados por los modelos, llamémosles, más tradicionales de cuidado (configurados a partir de la tradición prehispánica), en comunicación con los procesos modernizadores. Partiendo de tal planteamiento, la presente investigación retoma, temporalmente, eventos que influyen en la configuración de dichos procesos modernizadores desde 1808 hasta 2016, pero la atención se centra en la observación de tal encuentro (modelo tradicional y modelo moderno) en el presente. En el tercer apartado, se retoma la categoría de lo híbrido como una herramienta de análisis o recurso de explicación. A partir de los fragmentos de las historias de vida obtenidos vía las parteras, descritas en el cuarto apartado, es posible reconocer los procesos de comunicación y práctica “híbrida” utilizados por estos especialistas médicos. En el quinto apartado, se exponen los resultados de la investigación, haciendo énfasis en lo híbrido visto desde la formación y capacitación de las parteras, y los conocimientos adquiridos, así como los materiales y las técnicas de apoyo. Concluimos la presente investigación generando una serie de argumentos que nos permiten sostener por qué lo híbrido puede ser un medio de explicación para el encuentro entre formas (ancestral y moderna) de atención del embarazo, el parto y el puerperio, vía las parteras de la comunidad. Resumen: En el presente análisis proponemos una lectura del poemario Poemas da recordação e outros movimentos(2008) de Conceição Evaristo desde una perspectiva de la retórica subalterna, entendiendo lo anterior como la emergencia literaria de otras formas subjetivas. En este sentido afirmamos que en el poemario en análisis la subjetividad de la hablante se construye mediante la voz y el cuerpo femenino, afirmando la diferencia como sustento subjetivo. Resumen: En el siguiente análisis intentamos, por una parte, contextualizar la loa El divino Narciso de sor Juana Inés de Cruz dentro de los paradigmas estéticos y culturales de su época. Y por otra, reactualizar la lectura crítica de ella desde la perspectiva de una retórica o poética subalterna, entendiendo esto último como la deconstrucción literaria y su posterior reorganización de las significaciones que justificaron el colonialismo. Lo anterior tiene por finalidad dar cuenta cómo, mediante la manipulación precisa de los (...) códigos hegemónicos, se logra invertir los contenidos simbólicos de una de las representaciones más tempranas y persistentes del continente americano: la figura América-mujer, imagen que naturalizó y justificó su alteridad.: In the following analysis, we tried first to contextualize La loa El Divino Narciso from Sor Juana Inés de la Cruz within esthetical and cultural paradigms of her time. Then, we tried to update her critical reading from the perspective of a subordinate rhetoric or poetics. We understand it as the literary deconstruction and subsequent reorganization of the meanings that justified colonialism. This approach has the purpose of accounting for the way in which accurate manipulation of hegemonic codes makes it possible to reverse the symbolic contents of one of the earliest and most persistent representations of the American continent: the America-woman figure. La educación humanista en las universidades, parece ser una respuesta para los retos que acarrea la sociedad del conocimiento. En México, CETYS Universidad, pretende promover sistemáticamente entre sus estudiantes la formación del carácter, la cultura y la ciencia; así como el cumplimiento de exigencias éticas. En este estudio se describe la experiencia de aprendizaje de estudiantes de la escuela de ingeniería en la asignatura Ser humano y ética, se realizó un análisis cualitativo, emergieron tres categorías: Asumir una postura ética, Reflexión (...) personal sobre la sociedad y sus problemáticas, y Acercamiento a la filosofía y la ética. Los vertebrados usados en protocolos experimentales son reconocidos como sintientes, lo cual favorece su consideración desde la zooética, su protección en la legislación nacional e internacional, así como la salva- guarda de su bienestar. En consecuencia, se ha recurrido a otros modelos in vivo como los animales invertebrados para realizar investigación. Salvo casos particulares, los invertebrados no cuentan con la protección legal ni existe preocupación por su bienestar, en tanto que se les consideraba no sintientes. Por lo tanto, se realizó (...) una revisión de artículos científicos (de 1997 a 2022) para examinar la sintiencia entre los grupos Mollusca, Arthropoda y Nematoda, phyla ampliamente utilizados como modelos experimentales. Se encontraron dieciocho artículos que constataron un cierto grado de sintiencia en estos phyla, por lo que se propone su inclu- sión en la reflexión zooética. Este texto constituye un primer esfuerzo para procurar el bienestar de estos individuos utilizados en procedimien- tos experimentales. (shrink)

Researchers working in the field of ecosystem services (ES) have long acknowledged the importance of recognising multiple values in ecosystems and biodiversity. Yet the operationalisation of value pluralism in ES assessments remains largely elusive. The aim of this research is to present a taxonomy of values and valuation methods to widen the evaluative space for ES. First, we present our preanalytic positions in regards to the values and valuation of ES. Second, we review different value definitions that we deem relevant (...) for the discussion of ES valuation. Third, we propose a taxonomy of ES values based on different conceptions of human-nature relationships. Finally, we present a taxonomy of different methods that can be used to recognise plural values in ES. This taxonomy for a plural valuation can help ES scientists and practitioners with their aim of representing people's multiple and context-specific ways of valuing nature. The taxonomy can also serve to pay broader attention to ES values that are overlooked or misrepresented in assessments that restrict their focus to monetary valuations. (shrink)

En el siguiente documento se presentará una síntesis de las ideas centrales que arguye Antonin Artaud en su obra: El teatro y su doble para establecer, en la discusión sobre el arte, la idea del artista como un héroe desde una perspectiva ontológica, que no implica simplemente las representaciones sensibles de los héroes figurativos de las tradicionales obras trágicas. En esta nueva categorización, el artista se considerará como héroe teniendo en cuenta tres ejes fundamentales: primero, la relación espiritualidad-corporalidad; segundo, la (...) noción de crisis de la cultura como factor esencial en la constitución de un arte metafísico; y tercero, la idea de crueldad del arte como respuesta a lo que presenta el mundo. En este trabajo ofrecemos un panorama al estudio de los sesgos. El creciente interés en ellos durante las últimas décadas radica en que estudiarlos implica hablar de cómo los seres humanos razonamos y emitimos juicios, e igualmente sobre los mecanismos y procesos que subyacen a tales capacidades, esto incluye entender cuándo y por qué frecuentemente nos equivocamos, como lo indica buena parte de la literatura en psicología cognitiva del razonamiento. Dada la existencia de los sesgos, han surgido posturas pesimistas que (...) sostienen que los sesgos muestran que los humanos son irracionales. Frente a estas, la literatura reciente ofrece visiones mas optimistas, y aduce que los sesgos pueden “desaparecer” si se tienen en consideración diferentes aspectos de tipo evolutivo. Otra postura es aquella que sostienen que la supervivencia humana no yace en la inteligencia individual sino en la colectiva. Es decir, que podemos dejar de confiar exclusivamente en el contenido de nuestra mente y en su lugar resolver los problemas colectivamente, gracias a la división de las tareas cognitivas. Para organizar la exposición dividimos el trabajo en tres enigmas de los sesgos cognitivos. El primero consiste en una discusión sobre el origen de los sesgos. El segundo concierne a su clasificación e inventarios. El tercer enigma versa sobre la unidad de análisis de la cognición humana, a saber, inteligencia individual versus inteligencia colectiva. Con estos enigmas queremos poner de manifiesto el abanico de discusiones que giran alrededor de los sesgos, sus problemas, así como la creciente fascinación por entenderlos. Estudiar los sesgos abona a la comprensión de cómo razonamos o pensamos, y esto nos ayuda a mejorar nuestro pensamiento crítico. (shrink)

Several charters of rights have been issued in Europe to solemnly proclaim the rights of children during their hospital stay. However, notwithstanding such general declarations, the actual implementation of hospitalized children’s rights is unclear. The purpose of this study was to understand to which extent such rights, as established by the two main existing charters of rights, are actually implemented and respected in Italian pediatric hospitals and the pediatric units of Italian general hospitals, as perceived by the nurses working in (...) them. Parental burnout is a unique and context-specific syndrome resulting from a chronic imbalance of risks over resources in the parenting domain. The current research aims to evaluate the psychometric properties of the Spanish version of the Parental Burnout Assessment across Spanish-speaking countries with two consecutive studies. In Study 1, we analyzed the data through a bifactor model within an Exploratory Structural Equation Modeling on the pooled sample of participants obtaining good fit indices. We then attained measurement invariance across both gender (...) and countries in a set of nested models with gradually increasing parameter constraints. Latent means comparisons across countries showed that among the participants’ countries, Chile had the highest parental burnout score, likewise, comparisons across gender evidenced that mothers displayed higher scores than fathers, as shown in previous studies. Reliability coefficients were high. In Study 2, we tested the relations between parental burnout and three specific consequences, i.e., escape and suicidal ideations, parental neglect, and parental violence toward one’s children. The medium to large associations found provided support for the PBA’s predictive validity. Overall, we concluded that the Spanish version of the PBA has good psychometric properties. The results support its relevance for the assessment of parental burnout among Spanish-speaking parents, offering new opportunities for cross-cultural research in the parenting domain. (shrink)

Audiovisual communication is greatly contributing to the emerging research field of affective computing. The use of audiovisual stimuli within immersive virtual reality environments is providing very intense emotional reactions, which provoke spontaneous physical and physiological changes that can be assimilated into real responses. In order to ensure high-quality recognition, the artificial intelligence system must be trained with adequate data sets, including not only those gathered by smart sensors but also the tags related to the elicited emotion. Currently, there are very (...) few techniques available for the labeling of emotions. Among them, the Self-Assessment Manikin devised by Lang is one of the most popular. This study shows experimentally that the graphic proposal for the original SAM labelling system, as devised by Lang, is not neutral to gender and contains gender biases in its design and representation. Therefore, a new graphic design has been proposed and tested according to the guidelines of expert judges. The results of the experiment show an overall improvement in the labeling of emotions in the pleasure–arousal–dominance affective space, particularly, for women. This research proves the relevance of applying the gender perspective in the validation of tools used throughout the years. (shrink)

El presente escrito tiene por objetivo discutir los alcances de la denominada vía predicativa en el análisis de la rigidez de los términos generales. En particular, se analizará la interpretación que Zerbudis realiza de la propuesta desarrollada por Salmon. Se mostrará cómo ambas posturas, en tanto dependen de una lectura predicativa de la rigidez en los términos de clase, no responden al desideratum inicial kripkeano. Siguiendo a López de Sa, se sostiene que la vía nominal evita los problemas que (...) se derivan de una lectura predicativa reductiva. Específicamente, se sostiene que la vía nominal permite comprender cómo los enunciados de identidad teórica no corren el riesgo de trivialización. A partir del caso el color del cielo, se observa que la exigencia de admisión de identidad contingente obvia una tesis central de la propuesta kripkeana: la necesidad de la identidad. (shrink)

In this paper, I argue that nonhuman animals can be subject to epistemic injustice. I consider Miranda Fricker’s (2007) account of the nature of the harm of epistemic injustice and highlight that it requires that a knower be invested in being recognized as a knower. I argue that a focus on know-how, rather than testimony or concepts for self-understanding and communication, can serve to highlight how nonhuman animals can suffer epistemic injustice without an investment in recognition, by focusing on (...) distributive justice concerning epistemic goods. Drawing from work in animal ethology and movement ecology, I argue that human interruption of animal lifeways has negative downstream effects on nonhuman animals’ ability to acquire ‘answers’ to ‘questions’ they have an interest in answering: namely, acquiring both true beliefs about conspecifics and their environment, as well as acquisition of behaviors and skills that enable everyday successful coping, and that these interruptions can constitute epistemic injustice. Fricker shows that virtue epistemology provides a general epistemological idiom in which these issues can be forcefully discussed.

When we hope to explain and perhaps vindicate a practice that is internally diverse, philosophy faces a methodological challenge. Such subject matters are likely to have explanatorily basic features that are not necessary conditions. This prompts a move away from analysis to some other kind of philosophical explanation. This paper proposes a paradigm based explanation of one such subject matter: blame. First, a paradigm form of blame is identified—‘Communicative Blame’—where this is understood as a candidate for an explanatorily basic form (...) of blame. Second, its point and purpose in our lives is investigated and found to reside in its power to increase the alignment of the blamer and the wrongdoer's moral understandings. Third, the hypothesis that Communicative Blame is an explanatorily basic form of blame is tested out by seeing how far other kinds of blame can reasonably be understood as derivative, especially in respect of blame's point and purpose. Finally, a new and quasi-political worry about blame is raised. (shrink)

I shall first briefly revisit the broad idea of ‘epistemic injustice’, explaining how it can take either distributive or discriminatory form, in order to put the concepts of ‘testimonial injustice’ and ‘hermeneutical injustice’ in place. In previous work I have explored how the wrong of both kinds of epistemic injustice has both an ethical and an epistemic significance—someone is wronged in their capacity as a knower. But my present aim is to show that this wrong can also have a political (...) significance in relation to non-domination, and so to freedom. While it is only the republican conception of political freedom that presents nondomination as constitutive of freedom, I shall argue that non-domination is best understood as a thoroughly generic liberal ideal of freedom to which even negative libertarians are implicitly committed, for non-domination is negative liberty as of right—secured non-interference. Crucially on this conception, non-domination requires that the citizen can contest interferences. Pettit specifies three conditions of contestation, each of which protects against a salient risk of the would-be contester not getting a ‘proper hearing’. But I shall argue that missing from this list is anything to protect against a fourth salient threat: the threat that either kind of epistemic injustice might disable contestation by way of an unjust deflation of either credibility or intelligibility. Thus we see that both testimonial and hermeneutical injustice can render a would-be contester dominated. Epistemic justice is thereby revealed as a constitutive condition of non-domination, and thus of a central liberal political ideal of freedom. (shrink)

There are two kinds of forgiveness that appear as radically different from one another: one presents forgiveness as essentially earned through remorseful apology; the other presents it as fundamentally non-earned—a gift. The first, which I label Moral Justice Forgiveness, adopts a stance of moral demand and conditionality; the second, which I label Gifted Forgiveness, adopts a stance of non-demand and un-conditionality. Each is real; yet how can two such different responses to wrongdoing be of one and the same kind? This (...) paper explains how, by showing that the basic role each plays in moral-social life is the same; and that one is conceptually and therefore historically prior to the other. The result is pluralism, with each kind of forgiveness represented as distinctive in both its psychology and its normativity; and yet an ordered pluralism—with Moral Justice Forgiveness revealed as the root kind, and Gifted Forgiveness a culturally contingent iteration. This paper explores the relation between rational authority and social power, proceeding by way of a philosophical genealogy derived from Edward Craig's Knowledge and the State of Nature. The position advocated avoids the errors both of the 'traditionalist' (who regards the socio-political as irrelevant to epistemology) and of the 'reductivist' (who regards reason as just another form of social power). The argument is that a norm of credibility governs epistemic practice in the state of nature, which, when socially manifested, is (...) likely to imitate the structures of social power. BackgroundMoral distress (MD) is the psychological damage caused when people are forced to witness or carry out actions which go against their fundamental moral values. The main objective was to evaluate the prevalence and predictive factors associated with MD among health professionals during the pandemic and to determine its causes.MethodsA regional, observational and cross-sectional study in a sample of 566 professionals from the Public Health Service of Andalusia (68.7% female; 66.9% physicians) who completed the MMD-HP-SPA scale to determine the level (...) of MD (0-432 points). Five dimensions were used: i) Health care; ii) Therapeutic obstinacy-futility, iii) Interpersonal relations of the Healthcare Team, iv) External pressure; v) Covering up of medical malpractice.ResultsThe mean level of MD was 127.3 (SD=66.7; 95% CI 121.8-132.8), being higher in female (135 vs. 110.3; p<0.01), in nursing professionals (137.8 vs. 122; p<0.01) and in the community setting (136.2 vs. 118.3; p<0.001), with these variables showing statistical significance in the multiple linear regression model (p<0.001; r2=0.052). With similar results, the multiple logistic regression model showed being female was a higher risk factor (OR=2.27; 95% CI 1.5-3.4; p<0.001). 70% of the sources of MD belonged to the dimension "Health Care" and the cause "Having to attend to more patients than I can safely attend to" obtained the highest average value (Mean=9.8; SD=4.9).ConclusionsFemale, nursing professionals, and those from the community setting presented a higher risk of MD. The healthcare model needs to implement an ethical approach to public health issues to alleviate MD among its professionals. (shrink)

We gain information from collective, often institutional bodies all the time—from the publications of committees, news teams, or research groups, from web sites such as Wikipedia, and so on—but do these bodies ever function as genuine group testifiers as opposed to mere group sources of information? In putting the question this way I invoke a distinction made, if briefly, by Edward Craig, which I believe to be of deep significance in thinking about the distinctiveness of the speech act of testimony. (...) The distinction is that between somebody’s functioning as a ‘good informant’ and their functioning merely as a ‘source of information’. The difference between these has, as he remarks, a crucial ethical aspect: What I have in mind is the special flavour of situations in which human beings treat each other as subjects with a common purpose, rather than as objects from which services, in this case true belief, can be extracted. In this paper I shall try to bring out the distinctive nature of the role of good informant in a way that helps to clarify what is at stake in asking whether there can be group testimony in the sense of genuinely collective testimony—that is to say, where the group testifier is a collective and not merely a sum of individuals testifying in one or another form of aggregated chorus. The dual aim of this article is to reveal and explain a certain phenomenon of epistemic injustice as manifested in testimonial practice, and to arrive at a characterisation of the anti–prejudicial intellectual virtue that is such as to counteract it. This sort of injustice occurs when prejudice on the part of the hearer leads to the speaker receiving less credibility than he or she deserves. Interpreting Bernard Williams’s ethical philosophy is not easy. His style is deceptively conversational; apparently direct, yet argumentatively inexplicit and allusive. He is moreover committed to evading ready-made philosophical “-isms.” All this reinforces the already distinct impression that the structure of his philosophy is a web of interrelated commitments where none has unique priority. Against this impression, however, I will venture that the contours of his philosophy become clearest if one considers that there is a single, unchanging root conviction from which (...) his ethical philosophy grows. Despite the perpetual motion of his philosophical thought—its erudition, originality, range, and unceasing forward momentum—still, I contend, there is something unchanging at the heart of it. I will show this by reference to three signature theses: internal reasons, the relativism of distance, and the porous borders of philosophy and history. I will argue that the root conviction of which these are the fruits is the conviction that the constraints of universal rationality seriously underdetermine how one should live. This, I believe, is the vision of the human ethical condition that constitutes the largely inexplicit yet utterly fundamental presupposition beneath Williams’s ethical philosophy taken as a whole. I label the object of this root conviction ethical freedom, and thus portray Williams as a philosopher of ethical freedom. (shrink)

[T]he dominated live in a world structured by others for their purposes — purposes that at the very least are not our own and that are in various degrees inimical to our development and even existence.We are perhaps used to the idea that there are various species of oppression: political, economic, or sexual, for instance. But where there is the phenomenon that Nancy Hartsock picks out in saying that the world is “structured” by the powerful to the detriment of the (...) powerless, there is another species of oppression at work, one that has not been registered in mainstream epistemology: epistemic oppression. The word ‘structured’ may be read materially, so as to imply that social institutions and practices favour the powerful, or ontologically, so as to imply that the powerful somehow constitute the world. But for present purposes I am interested only in an epistemological reading, which implies that the powerful have some sort of unfair advantage in “structuring” our understandings of the social world. I will try to present an account of what this initially vague idea involves. I hope thereby to explain an exact sense in which the powerful can have a kind of epistemic advantage that means the powerless are epistemically oppressed. (shrink)

Our understanding of social experiences is central to our social understanding more generally. But this sphere of epistemic practice can be structurally prejudiced by unequal relations of power, so that some groups suffer a distinctive kind of epistemic injustice—hermeneutical injustice. I aim to achieve a clear conception of this epistemicethical phenomenon, so that we have a workable definition and a proper understanding of the wrong that it inflicts.

My overarching purpose is to illustrate the philosophical fruitfulness of expanding epistemology not only laterally across the social space of other epistemic subjects, but at the same time vertically in the temporal dimension. I set about this by first presenting central strands of Michael Williams' diagnostic engagement with scepticism, in which he crucially employs a Default and Challenge model of justification. I then develop three key aspects of Edward Craig's ‘practical explication' of the concept of knowledge so that they may (...) be seen to resonate positively with Williams's epistemological picture: the admixture of internalist and externalist features; the proto-contextualism; and, finally, the distinctively genealogical antisceptical impetus. In this way I aim to support and augment the socialized anti-sceptical case mounted by Williams, and so to show that expanding epistemology in the temporal dimension can be a productive move in central debates in epistemology. Objetivo: El siguiente artículo tiene como propósito la revisión de la literatura existente cuyo enfoque sea las herramientas tecnológicas utilizadas para el abordaje del paciente con síntomas de salud mental, de manera virtual, para describir las ventajas, la eficacia, la efectividad y los beneficios de estas herramientas, a partir de la literatura encontrada. Métodos: se realizó una búsqueda en las bases de datos Pubmed, Elsevier, UpToDate, Journal of Medical Internet Research y Google Académico. Se identificó un total de 58 artículos (...) que versan sobre la eficacia y efectividad de las diferentes modalidades digitales (tales como aplicaciones, cuestionarios en línea, mensajes de texto, etc.) que tratan la salud mental. Resultados: la búsqueda realizada arrojó un total de 58 artículos. Tras la eliminación de duplicados, el número fue de 50 artículos. Después de la caracterización de la información basada en la revisión de la totalidad del contenido, fueron elegidos 30 artículos para que sirvieran como base para la construcción de la síntesis de datos. Conclusiones: las herramientas virtuales utilizadas en salud mental ofrecen un sin fin de beneficios para prestar un servicio con un acceso más sencillo a la población, de forma económica y efectiva, sin temor a que los pacientes sean estigmatizados al momento de buscar ayuda, como se pudo evidenciar en los artículos presentados. Además, las herramientas digitales utilizadas en psiquiatría han demostrado ser eficaces y seguras, sin embargo, son de reciente aparición y cuentan con una cantidad limitada de estudios que demuestren objetivamente su eficacia en esta área. Tradicionalmente, el patrimonio se ha relacionado con la educación histórica desde una perspectiva restrictiva que dejaba fuera a buena parte de las manifestaciones patrimoniales, entre ellas, las que se incluyen en el ámbito del patrimonio inmaterial. En este sentido, el presente trabajo se centra en la relación entre patrimonio inmaterial y pensamiento histórico dentro de la formación del profesorado de Educación Primaria. Desde el paradigma interpretativo se han analizado 27 propuestas didácticas de un total de 54 estudiantes del Grado de (...) Educación Primaria, con el propósito de conocer la percepción que poseen del uso del patrimonio inmaterial para trabajar los conceptos asociados al desarrollo del pensamiento histórico. Los datos obtenidos apuntan a la existencia de una alta consideración del patrimonio inmaterial para trabajar el pensamiento histórico en la Educación Primaria. (shrink)

The current literature on the value of knowledge is marred by two unwarranted presumptions, which together distort the debate and conceal what is perhaps the most basic value of knowledge, as distinct from mere true belief. These presumptions are the Synchronic Presumption, which confines philosophical attention to the present snapshot in time; and the Analytical Presumption, which has people look for the value of knowledge in some kind of warrant. Together these presumptions conceal that the value of knowledge might inhere (...) not in a necessary condition, but simply in a property that most knowledge possesses; and, in particular, that it might inhere, as I argue it does, in a certain property of 'resilience': the tendency to survive misleading counter-evidence over time owing to the subject's being in a position to weight it against evidence already possessed. Los Estados confederados proyectan la existencia de un doble sistema normativo: federal y local. Esto provoca el surgimiento de colisiones y contradicciones entre ambos sistemas, lo que se pensaría debería ser resuelto por el derecho internacional, atendiendo el principio de subsidiariedad, no obstante, esto no siempre es así, ya sea porque el derecho internacional no regule ese caso concreto o bien, porque el Estado en cuestión no haya otorgado su consentimiento y la respuesta no le sea vinculante. Estas reflexiones invitan (...) a contrastar la naturaleza de las normas del derecho local y del derecho internacional, pues mientras que las primeras son asociativas, dado que no necesariamente requieren ser consentidas para ser vinculantes, las segundas, aparentemente, sí requieren el consentimiento de los Estados para que tengan efectos vinculantes. En este artículo pretendemos postular una posible solución al problema del conflicto entre los distintos órdenes normativos, partiendo desde una postura cuasi-voluntarista. Las obligaciones cuasi-voluntarias son aquellas que no surgen del consentimiento, pero tampoco completamente de los roles que tienen los Estados en el sistema internacional. Estas obligaciones nacen en el núcleo de grupos dominantes, a los que llamaremos grupos autocontenidos en el ámbito internacional, que tienen como rol la creación y socialización de las normas y obligaciones de derecho internacional, logrando que los otros grupos simplemente las sigan como si tuvieran un deber de hacerlo. Para ello, servirá como referencia el análisis del caso de las disimiles normas migratorias entre California y Texas dentro de Estados Unidos. (shrink)

I consider Katherine Hawley's commitment account of interpersonal trustworthiness alongside her sceptical challenge regarding the value of philosophically modelling institutional trustworthiness as distinct from reliability. I argue, pace Hawley's challenge, that there would be significant diagnostic and explanatory loss if we were to content ourselves with ideas of institutional (un)reliability alone; and I offer an illustrative case where institutional unreliability is only the half of it, indicating that when it comes to certain kinds of institutional dysfunction, we do need philosophical (...) models of institutional ‘distrustworthiness’ if we are to achieve a proper diagnosis. The history of moral relativist thinking features different branches to the family tree, each representing a different impetus to relativism, and so producing a different style of moral relativist thought. At the root, however, is a broadly subjectivist parent idea that morality is at least in part the upshot of a shared way of life, and shared ways of life tend to vary markedly from culture to culture. La fenomenología distingue el cuerpo-objeto (Körper) del cuerpo vivido (Leib); se interesa por este último y por el cuerpo que se nos manifiesta en nuestras experiencias y les da expresión. Este cuerpo fenoménico es el punto cero de nuestras vidas, el anclaje de nuestra existencia. La fenomenología de Simone de Beauvoir le aplica la diferencia sexual.Esta contribución continúa la hermenéutica de Beauvoir centrándose en su conocida máxima, “no se nace mujer, se llega a serlo”, teniendo en cuenta que las interpretaciones (...) se dan desde y para determinadas situaciones. La nuestra es el siglo XXI y las investigaciones fenomenológicas y feministas. Dado que la traducción es un modo de interpretación, señalaremos cómo El segundo sexo ha contribuido a comprender el devenir mujer. Para ello, en primer lugar, expondremos nuestra concepción hermenéutica de la traducción. Destacaremos después el “estilo” fenomenológico de Beauvoir y las influencias recíprocas con Merleau-Ponty para abrir la posibilidad de una diferencia sexual sin determinismos. (shrink)

Se trata de revisar el expresivismo respecto a emisiones de la forma "Creo que p". El expresivista sostiene que una emisión de "Creo que llueve" es una expresión, y no una descripción, de la creencia de que llueve. Se propone una variación del expresivismo según la cual una emisión así expresa la creencia consciente de que llueve, en el sentido de la teoría de la conciencia de Brentano: una creencia consciente de que llueve tiene el contenido de que llueve y (...) de que él mismo, el creyente, cree que llueve.
